Effective October 5, 2009, the Digital Court Recording Office began digitally recording all felony proceedings with the following exceptions, which are set forth in Administrative Order No. 2010-1.2:
  1. all trials;
  2. testimony in grand jury proceedings;
  3. all hearings in capital cases;
  4. all post conviction hearings in cases in which the defendant is serving a prison sentence of ten years or more;
  5. any other proceedings in which the presiding judge may require a court reporter. See FLA. R. Jud. Admin. 2.535(g)(3)
