Acceptance of Gifts by Judges
and Court Employees
Upon direction by the Florida Supreme Court, and review of the Judicial Ethics Advisory Committee Opinion 2000-08, it is therefore,
Ordered and Adjudged as follows:
A judge and/or a court employee may not accept gifts, including money and redeemable gift certificates, bequests, favors or loans from lawyers, vendors, or other third parties except as governed by Canon 5D of the Code of Judicial Conduct. A judge is ethically obligated to instruct court personnel to act in a manner consistent with the judge’s ethical duties and obligations by directing them not to accept such donations.
If the circumstances are such that a judge may ethically accept such a donation, the judge must report it pursuant to the terms and conditions of Canon 6 of the Code of Judicial Conduct, if the value of the donation exceeds $100.00.
