Formal Notice in Probate Proceedings

Section 731.301, Florida Statutes (2000), and Florida Probate Rule 5.040 direct formal service of process in probate proceedings “by any form or mail or by any commercial delivery service approved by the chief judge of each judicial circuit, requiring a signed receipt.” FedEx Express (Federal Express) is a carrier providing commercial delivery service, in which the sender may obtain a written return receipt. It is therefore,

Ordered and Adjudged as follows:

  1. FedEx Express (Federal Express) shall constitute an approved commercial delivery service, pursuant to the service requirements of section 731.101, Florida Statutes (2000), and Florida Probate Rule 5.040.
