Magistrate / Hearing Officer

The Twelfth Judicial Circuit has appointed Magistrates and Support Enforcement Hearing Officers to handle domestic/family law issues, Circuit Civil Motions, Collections Court, Dependency Reviews, Probate and Marchman/Baker Act hearings.

The Magistrates are assigned to hear all Marchman and Baker Act proceedings, and issue findings and a recommended order in all proceedings to determine the involuntary placement of an individual. All parties must agree to allow the Magistrates to hear and determine the issues. If any party objects, the case will be heard by the Circuit Judge assigned to the probate division.

The Magistrates are also assigned to hear any domestic matters referred by the Circuit Judge, including dissolution of marriage; parental responsibility; time-sharing; the establishment, enforcement, or modification of a Parenting Plan; contested paternity issues; property rights of the parties; attorney fees; or any other issues referred by the Court. All parties must agree to allow the Magistrates to hear and determine the issues. If any party objects, the issues will be heard by the Circuit Judge assigned to the case.

The Support Enforcement Hearing Officer hears all proceedings involving the establishment, modification, and enforcement of support; and uncontested paternity issues, in both Title IV-D and Non IV-D cases. In Title IV-D cases, one party has contracted with the Florida Department of Revenue for services and the cases are prosecuted by the contract attorney for the Florida Department of Revenue. Non IV-D cases are those cases in which both parties are represented by private attorneys. The parties are not required to give their consent to the referral of the issues to the Hearing Officer and cannot object to the referral of the issues.

All hearings before the Magistrates or the Support Enforcement Hearing Officers are electronically recorded as provided by the Florida Rules of Judicial Administration.

The Magistrates and Support Enforcement Hearing Officers duties and appointments are done pursuant to Administrative Orders signed by the Chief Judge, and as provided for by Florida Statutes, the Family Law Rules of Procedure, and the Rules of Civil Procedure.
